Notice of Bylaw Amendment: Deadline for Public Submissions - Lakes Zoning Amendment Bylaw No. 900-35C

What is Lakes Zoning Amendment Bylaw No. 900-35C (BL900-35C)?

The subject property is located at 3700 Sunnybrae-Canoe Point Road in Sunnybrae of Electoral Area C and is more particularly shown in bold outline on the map below:

The owners are applying to rezone the foreshore to allow for a raised permanent walkway and a fixed dock (33.45 m2). The FR1 – Foreshore Residential 1 zone permits only a floating dock and removable walkway. The proposal is to rezone the foreshore adjacent to the subject property from FR1 – Foreshore Residential 1 to FG1 – Foreshore General 1, which will permit a fixed dock and permanent walkway.

Public Hearing Not Required

This bylaw amendment proposal is consistent with the policies contained in Electoral Area C Official Community Plan Bylaw No. 725. Section 464(2) of the Local Government Act states that a local government is not required to hold a public hearing on a proposed zoning bylaw if an official community plan is in effect for the area that is the subject of the zoning bylaw, and the bylaw is consistent with the official community plan. As this bylaw amendment is consistent with the OCP, a public hearing is not required to be held.

In accordance with Section 8.1.1 of Development Services Procedures Bylaw No. 4001, all owners of property within 100 m of the subject property must be sent notices advising that there will not be a public hearing and be given the opportunity to provide comment about the bylaw amendment.

Where and when will the application be considered by the Board?

The application will be considered for second and third reading and adoption at the CSRD, 555 Harbourfront Drive NE, Salmon Arm, BC, during the Regular Board Meeting commencing at 9:30 AM on Thursday, May 19, 2022. 

The Regular Meeting will convene in the CSRD Boardroom with a combination of in-person and virtual attendance. There is no specific opportunity for the public to provide verbal or written submissions about this application at this meeting.
