What is Electoral Area E Zoning Amendment Bylaw No. 841-01 (BL841-01)?

The subject property is located at 9862 Old Spallumcheen Rd near Mara Point in Electoral Area E and is more particularly shown in bold outline on the map below:

The owners of Hyde Mountain Golf Course are applying for a bylaw amendment in order to create a subdivision for the seasonal use of recreational vehicles (RVs) and confirm that a helicopter tour business can operate on the golf course properties.

RV lots would be a minimum 290 m2 served by community water and community sewer systems and could only be accommodated between March 1 and October 31 of each calendar year.  

Public Hearing Not Required

This bylaw amendment proposal is consistent with the policies contained in Electoral Area E Official Community Plan Bylaw No. 840. Section 464(2) of the Local Government Act states that a local government is not required to hold a public hearing on a proposed zoning bylaw if an official community plan is in effect for the area that is the subject of the zoning bylaw, and the bylaw is consistent with the official community plan. As this bylaw amendment is consistent with the OCP, a public hearing is not required to be held.

In accordance with Section 8.1.1 of Development Services Procedures Bylaw No. 4001, all owners of property within 100 m of the subject property must be sent notices advising that there will not be a public hearing and be given the opportunity to provide comment about the bylaw amendment.

Where and when will the application be considered by the Board?

The application will be considered for First reading at the CSRD, 555 Harbourfront Drive NE, Salmon Arm, BC, during the Regular Board Meeting commencing at 9:30 AM on Thursday, March 17, 2022. 

The Regular Meeting will convene in the CSRD Boardroom with a combination of limited in-person and virtual attendance. Due to COVID-19 Public Health restrictions, in-person attendance in the Boardroom is restricted to 15 people, so there will be limited seats available to the public. These seats are first come, first served and cannot be reserved. Masks are required. Alternatively, the public may join the meeting electronically via Zoom. Another notice will be mailed to you advising of the deadline for written submissions.
