What is Electoral Area B Zoning Amendment Bylaw No. 851-26 (BL851-26)?

The subject property is located at 1630 Mt. Begbie Road in the Begbie Bench area of Electoral Area B and is more particularly shown on the map below:

The applicant has applied to amend Electoral Area B Zoning Bylaw No. 851 to add a special regulation to the Small Holdings zone to permit year-round vacation rental use of the secondary dwelling on the subject property. 

Vacation rental use of the principal dwelling is currently permitted between December 1 to April 30 by Temporary Use Permit 850-03.  This Temporary Use Permit is set to expire in September 2022.

The above descriptions of the purpose and effect of Bylaw No. 851-26 are only general. The bylaw may have an impact on property owners and tenants in occupation within the area. It is, therefore, important for all property owners and tenants in occupation to inform themselves fully as to the nature and effect of the bylaw.

Public Hearing Not Required

This proposed bylaw amendment is consistent with the policies contained in Electoral Area B Official Community Plan Bylaw No. 850. More specifically, the subject property is designated Small Holdings (SH) which is a residential designation deemed suitable for vacation rentals.  

Therefore, this proposed bylaw amendment does not require an amendment to the Official Community Plan (OCP).

Section 464(2) of the Local Government Act states that a local government is not required to hold a public hearing on a proposed zoning bylaw if an OCP is in effect for the area that is the subject of the zoning bylaw, and the bylaw is consistent with the OCP. As this bylaw amendment is consistent with the OCP, a public hearing is not required to be held.

In accordance with Section 8.1.1 of Development Services Procedures Bylaw No. 4001, all owners of property within 100 m of the subject property must be sent notices advising that there will not be a public hearing and be given the opportunity to provide comment about the bylaw amendment.

Where and when will the application be considered by the Board?

The application will be considered for first reading at the CSRD, 555 Harbourfront Drive NE, Salmon Arm, BC, during the Regular Board Meeting commencing at 9:30 AM on Thursday, March 17, 2022. 

The Regular Meeting will convene in the CSRD Boardroom with a combination of limited in-person and virtual attendance. Due to COVID-19 Public Health restrictions, in-person attendance in the Boardroom is restricted to 15 people, so there will be limited seats available to the public. These seats are first come, first served and cannot be reserved. Masks are required. Alternatively, the public may join the meeting electronically via Zoom. Written submissions will be accepted at the CSRD office, 555 Harbourfront Drive NE, Salmon Arm, BC, from Thursday, March 17, 2022 until 4:00 PM the Tuesday the week of the Board meeting at which the subject application is being considered for third reading (future date to be determined). Another notice will be mailed to you advising of the deadline for written submissions. The Board of the CSRD considers the author's name and residential address relevant to the Board's consideration of this matter and should be included in your submission. The author's phone number and email address are not relevant to the Board’s consideration of this matter and should not be included in the written submission.
