Temporary Use Permits
There are three categories of Temporary Use Permits in use at the CSRD:
- Board Approved
- Delegated
- Renewals
Through the Local Government Act, Official Community Plans (OCPs) may designate areas where TUPs can be considered. In the CSRD, TUPs are an option in Electoral Areas B, D, E and F.
Temporary Use Permit (Board Approved)
A Temporary Use Permit (TUP) is a short-term rezoning. A TUP may be considered by the CSRD Board of Directors to allow specific land uses for a set period of time when the existing zoning does not permit those specified uses. The permit can contain detailed requirements such as indicating the buildings that can be used, the time frame of the permit, and other conditions.
A Temporary Use Permit is valid for a maximum of three years after it is issued and may be renewed once for an additional three years. Board Approved TUP’s typically take three to six months to process. They are subject to notification requirements that include:
- posting a sign,
- advertising the proposal in a newspaper ad,
- mailing notices to adjacent property owners within 100 meters of the subject property.
Temporary Use Permit (Delegated)
In areas where there is a zoning bylaw, there is an option to apply and seek approval from the Manager of Development Services for a Temporary Use Permit to allow conditional occupancy of a seasonally used (May to October) recreational vehicle (RV) or a secondary dwelling unit, while constructing a principal dwelling on the property.
Temporary Use Permits may be considered and renewed once by the Manager to authorize the construction or conditional occupancy of a seasonal RV or secondary dwelling unit use in these situations:
- Seasonal RV or secondary dwelling unit is serviced by an approved sewer system and potable water source,
- Seasonal RV or secondary dwelling unit is only utilized for the purposes of the landowner’s accommodation during the construction of a principal dwelling,
- Building plans or building permit is ready to be issued for proposed principal dwelling,
- Security payment is received.
Delegated TUP’s typically take two to four months to process and are subject to notification requirements that include:
- posting a sign,
- advertising the proposal in a newspaper ad,
- mailing notices to adjacent property owners.
Temporary Use Permit (Renewal)
A Temporary Use Permit is valid for a maximum of three years after it is issued and may be renewed once for an additional three years.
Temporary Use permit renewals may be considered by the Manager of Development Services where:
- No additional changes to the initial permit have been requested by the applicant,
- There are no issues of non-compliance with the original permit,
- The permit renewal application has been received at least three months prior to expiration of the permit. (If an application has not been received within three months of expiry, a new TUP permit must be considered by the CSRD Board of Directors.)
Temporary Use Permit Renewals delegated to the manager that meet the requirements do not need to post a sign or require a newspaper ad. Notices are required to be mailed to adjacent property owners.
